1) Scope & Acceptance

These Terms & Conditions (“Terms”) govern your access to and use of the Brew Wave Coffee website at www.brewwavecoffee.com (the “Site”), online ordering, gift cards, loyalty or promotional programs, and any related in-store pickup or catering services (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy (incorporated by reference).


2) Products, Menu & Allergen Notice

• We make every effort to display our menu items, products, and descriptions as accurately as possible. However, availability, pricing, and ingredients may change without notice.

• All food and beverage items are subject to availability.

• Allergen Notice: Brew Wave Coffee products may contain or come into contact with common allergens, including nuts, dairy, soy, and gluten. Please contact us at nb@brewwavecoffee.com if you have any questions.

• Cross-contact can occur. If you have allergies, please notify a team member before ordering. Ingredients and nutrition information may vary by day or season.


3) Orders, Pricing & Payments

• By placing an order through our website, you agree to provide accurate, complete, and current information.

• Payment must be made in full at the time of order using accepted payment methods.

• Brew Wave Coffee reserves the right to refuse or cancel any order if fraud or unauthorized activity is suspected.

• Prices are shown before applicable taxes and fees. We may correct pricing or availability errors and cancel or refund orders affected by such errors.

• Tips are voluntary and non‑refundable.


4) Pickup, Substitutions & Third‑Party Delivery

• Pickup windows: Please collect orders promptly; quality declines quickly for temperature‑sensitive items (e.g., espresso drinks, Acai Bowls, smoothies). We are not responsible for product condition after the pickup window.

• Substitutions: When specific ingredients are unavailable, we may substitute items of equal or greater value and will attempt a like‑for‑like replacement.

• Third‑party delivery (e.g., DoorDash/Uber Eats): Orders placed through a third party are subject to that provider’s terms and prices. Delivery issues should be directed to the provider; we will reasonably assist where we can.


5) Refunds, Credits & Cancellations

• All sales are final unless otherwise stated.

• If you are unsatisfied with your purchase, please contact us at nb@brewwavecoffee.com or (619) 888‑8222 within 48 hours, and we will review on a case‑by‑case basis.

• Refunds, store credits, or replacements are at our discretion.

• Chargebacks: Please contact us first to resolve any issues. Unauthorized or fraudulent chargebacks may be contested with your payment provider.

• Made‑to‑order beverages and foods are generally not eligible for refunds once prepared, except where required by law or for verified quality/fulfillment errors.


6) Intellectual Property

• All content on this website, including text, images, logos, graphics, and design, are the property of Brew Wave Coffee unless otherwise noted.

• You may not copy, reproduce, or distribute our content without prior written permission.


7) User Content & Reviews

If you post reviews, photos, or feedback, you grant Brew Wave Coffee a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display that content in connection with the Services. Do not post unlawful, infringing, or abusive content; we may remove such content.


8) Acceptable Use

You agree not to: (a) access the Site using automated means; (b) interfere with security or integrity; (c) scrape or copy content except as permitted; or (d) misuse the Services for unlawful purposes.


9) Third‑Party Links

• Our website may include links to third‑party websites for your convenience. Brew Wave Coffee is not responsible for the content, policies, or practices of third‑party sites.


10) Communications; SMS/Email Consent

If you opt in to receive SMS or email updates, you consent to receive marketing and transactional messages. Message/data rates may apply. You can opt out at any time (SMS: reply STOP; email: use the unsubscribe link). See our Privacy Policy for details.

12) Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.


13) Limitation of Liability

• To the fullest extent permitted by law, Brew Wave Coffee is not liable for any damages arising from your use of the website, purchase of products, or reliance on provided information.

• We are not responsible for delays or failures caused by events beyond our reasonable control.

• In any event, our total liability for any claim will not exceed the amount you paid for the applicable order.


14) Indemnity

You agree to indemnify and hold harmless Brew Wave Coffee and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or violation of these Terms.


15) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including supply shortages, labor actions, utility outages, or natural disasters.


16) Gift Cards, Store Credit & Promotions

• Gift Cards issued by Brew Wave Coffee do not expire and generally carry no fees. California cash‑out: If a card balance is under $10, you may request cash back in store.

• Store credits and promotional vouchers are not legal tender, have no cash value, and may carry expiration dates or restrictions.

• Loyalty points, discounts, and offers are subject to change or termination at any time; not transferable; cannot be combined unless expressly stated.


17) Privacy

• Your use of the website is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.


18) Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of California. Venue and jurisdiction lie in the state and federal courts located in San Diego County, California. Before filing a claim, you agree to first attempt informal resolution by emailing nb@brewwavecoffee.com with a description of the issue.


19) Changes to These Terms

• Brew Wave Coffee reserves the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.

• Continued use of the website after changes are posted constitutes your acceptance of the updated Terms.
